i suppose it depends on if the father is involved with your child or not. If he is then it can't hurt to have a letter with you - it would make things easier at immegration stops. If he is not involved with your child there is not much that you can do there, but maybe get a letter stating that you have sole custody from your lawyer. I have encountered many anoying questions about this when traveling with my child. And my child's biological father left before he was born and has no contact with us at all.

I'm stuck in a tough position with this as well. I share legal custody of my daughter and father is refusing to allow her to fly to Florida with me (because we will be cruising out of the country). I've decided to take my niece instead but the air ticket is non-changeable/non-refundable. Is there any reason I shouldn't take my niece under the assumption that she is my daughter, so that I don't have to purchase another ticket due to name change?

I see your post was quite some time ago, but I am facing the same thing. Did you have any problems traveling with your child? Did you only need the court papers, because that's all I have; only the documents showing I have sole legal and physical custody. I know he will never give me a letter. (he doesnt even want to support them, let alone letting me take them to Mexico)

As you'll see from my guide sheet the issue is a lot more than just legal custody, there are issues relating to parental liability.
I've included some pointers on how to resolve common problems and I have taken the view that voluntary conscent is prefarable to taking the legal route.
